Any interaction with BAR SOLUTIONS, and in particular the placing of an order for products with BAR SOLUTIONS, may involve the collection and processing of certain personal information within the meaning of the General Data Protection Regulation of the European Parliament and of the Council No. 2016/679 of 27 April 2016 (hereinafter the " GDPR ") and the Data Protection Act No. 78/17 of 6 January 1978 in its version resulting from Law No. 2018/493 of 20 June 2018 [M (hereinafter the " Data Protection Act ") .

This privacy policy, which supplements BAR SOLUTIONS' general terms and conditions of sale, has been drawn up to enable BAR SOLUTIONS' customers, suppliers and service providers (hereinafter " You ", " Your " or " Yours ") to understand what data is collected, for what purposes, and what their rights are in this regard.

This Privacy Policy may be amended from time to time. Any amendments will be implemented after informing You, for example, through a banner on the BAR SOLUTIONS website accessible at the URL address www.barsolutions.fr (hereinafter the " Site ") or by any other available means. In this case, the "Last Updated" date mentioned above will be modified. The new version of the policy will come into effect from this date.

1.          Who is responsible for the data processing implemented?

The person responsible for processing personal data implemented by BAR SOLUTIONS is the company BAR SOLUTIONS, a limited liability company with a capital of 1,000 euros, identified under number 521 678 516 RCS Paris, whose registered office is 24 rue des Amandiers 75020 Paris, represented by its Manager (hereinafter " BAR SOLUTIONS ", " We ", " Our " or " Us ").

2.          When is personal data collected and processed by BAR SOLUTIONS?

BAR SOLUTIONS may be required to collect and process personal data within the meaning of the GDPR and the Data Protection Act in several situations:

-              when placing an order for products : whether this order is placed online on the Site or by mail, BAR SOLUTIONS must collect and process certain personal data relating to its customer for the proper processing of the order;

-              when you subscribe to the BAR SOLUTIONS electronic newsletter : this subscription requires the provision of an electronic address (e-mail) which will allow BAR SOLUTIONS to send you the newsletter;

-              when BAR SOLUTIONS places an order for products  : BAR SOLUTIONS must also collect certain personal data relating to its suppliers for identification purposes;

-              when you browse the Site : BAR SOLUTIONS may be required to collect certain technical personal data;

-               when BAR SOLUTIONS enters into a contract with a service provider : BAR SOLUTIONS may be required to collect certain personal data.

-              when you fill out a contact form: BAR SOLUTIONS may be required to collect certain personal data to contact you.

3.          What personal data is collected and processed by BAR SOLUTIONS?

BAR SOLUTIONS applies the principle of data minimization , which means that it only collects and processes personal data strictly necessary to achieve its corporate purpose.

Indeed, BAR SOLUTIONS does not trade in personal data. BAR SOLUTIONS only collects and processes data to enable it to successfully carry out its business of selling bar products and equipment.

The data collected and processed by BAR SOLUTIONS are as follows:

-               when placing an order : when You place an order with BAR SOLUTIONS, You must provide information relating to Your identity (surname, first name), Your address (as well as the place of delivery of the products) and a means of contacting You (such as an e-mail address and/or a telephone number). BAR SOLUTIONS may also be required to collect and process banking data in order to allow payment for the order. Bank card numbers are not collected or processed by BAR SOLUTIONS but by its payment service provider, SOGENACTIF. Data relating to Your orders is also kept by BAR SOLUTIONS;

-              when you subscribe to the BAR SOLUTIONS electronic newsletter : We then collect your email address to be able to send you our newsletter;

-              when BAR SOLUTIONS places an order for products : Our suppliers are generally identified by a company name (non-personal data relating to a legal entity) but also by the name of a contact person or representative, as well as their contact details (postal address, telephone number, email address, etc.);  

-               When you browse the Site , certain personal data concerning You is collected and processed by Us. This data is collected automatically. This includes: the IP (Internet Protocol) address of the computer terminal You are using, the date and time of connection, the type of computer used, the operating system and navigation software used, the resolution of your screen, as well as the name of your internet service provider. We also store the pages of the Site that You have consulted. This data is used by Us to personalize your navigation on the Site, to ensure the correct establishment of the connection, to evaluate the security of the system and to determine usage statistics.  They are collected through cookies , i.e. text files which are then stored on the storage medium of your terminal;

In principle, the Site is not designed to collect or process personal data of a "sensitive" nature within the meaning of the GDPR and the Data Protection Act.

4.          On what legal basis is personal data collected and processed?

BAR SOLUTIONS does not collect or process any unlawful personal data. All personal data collected and processed by BAR SOLUTIONS is done so under a duly identified legal basis:

-               for the most part, the data We collect is necessary for the performance of a contract between You and Us (either because You place an order with Us or because We place an order with You);

-               certain data collected automatically are necessary for the legitimate purposes that We pursue (in particular the establishment of connection statistics to the Site), it being specified that neither the collection nor the processing of this data is likely to harm the interests or fundamental freedoms that are Yours. This is harmless technical data, which is also collected by the vast majority of current websites;

-               The other personal data that We collect and process are based on Your consent. We invite You to only provide us with information that is strictly necessary.

5.          How do we use the data we collect?

BAR SOLUTIONS only uses the personal data collected in the cases described above for specific and legitimate purposes, which fall within the strict framework of its commercial activities, in accordance with its corporate purpose.

Schematically, these purposes are as follows:

-         primarily, this data is used for the proper execution of a product order: this is particularly the case for Your contact details;

-        this data may be processed for the purposes of sending our electronic newsletter : this is the case for your e-mail address;

-        this data may also be used for commercial prospecting purposes by email;

-         Finally, some information is useful to Us to administer the Site. We analyze it (directly or through third parties with whom We contract) in order to establish usage statistics (for example, to understand which pages are most visited) and to improve the Site by enhancing its functions and features. This information will allow Us, where appropriate, to improve our product offering. We may also use the address of Your terminal to combat certain cases of fraud, including identity theft.

6.      Who is the data we collect shared with?

The personal data we collect is primarily used by BAR SOLUTIONS itself. This data is intended for BAR SOLUTIONS' e-commerce, marketing, and IT departments.

This data may also be transmitted to certain recipients listed in a limited manner, namely:

-         our service providers: we may contract with third-party service providers to help us operate the Site and implement its functionalities. This concerns firstly SOGENACTIF, our service provider responsible for implementing the payment of online transactions. Secondly, it concerns the transport providers who will be responsible for delivering Your order (La Poste or a private carrier). Finally, it concerns SELLSY , the tool that We use to send Our electronic newsletter.

All of these service providers are subcontractors of BAR SOLUTIONS, expressly bound by written contract not to disclose or use information about You for any other purpose.  They are in fact contractually bound by confidentiality and security obligations at least equivalent to those provided for in this confidentiality charter.

-         the authorities: We must, where appropriate, cooperate with state, administrative or judicial authorities, in particular the supervisory authorities responsible for ensuring the implementation of the GDPR and the Data Protection Act, when We are required to do so. Consequently, We reserve the right to disclose any information collected in the course of Our activities to the competent authorities when We are required to do so, for example in the context of an investigation resulting from a bank card theft.

7.      How long is your personal data kept by BAR SOLUTIONS?

BAR SOLUTIONS stores your personal data in an identifiable form for the strict duration necessary to fulfill the purpose of the processing in question. Thus, schematically:

-        the data relating to Your orders, including Your purchase history, are kept in accordance with the rules set out by the Commercial Code regarding the archiving of accounting documents, as well as the provisions of the Consumer Code relating to the retention of contracts concluded electronically;

-        data relating to Our orders, including Our purchase history, are kept in accordance with the rules set out by the Commercial Code regarding the archiving of accounting documents;

-         the data collected to enable the sending of the BAR SOLUTIONS electronic newsletter is kept until you unsubscribe, it being specified that each message sent to you includes an unsubscribe link [MB5] ;

-        the data collected automatically and which concerns Your browsing session on the Site are automatically deleted when You log out.

Other data, in particular statistics, are stored in an anonymized form that does not allow your identification.

8.      What are your rights regarding your personal data?

BAR SOLUTIONS respects the rights granted to you by the GDPR and the Data Protection Act.

You therefore have the right to request access to the personal data concerning You which is stored by BAR SOLUTIONS, as well as the rectification or erasure of this data, or even the limitation of the processing relating to the personal data concerning You, as well as the right to object to their processing.

However, in the event of limitation of processing or opposition to processing, BAR SOLUTIONS may no longer be able to process Your order, or even give You access to the Site in a personalized manner. Furthermore, in the event of exercising the right of opposition or the right to be forgotten, certain information may still be retained by BAR SOLUTIONS in order to comply with its legal obligations.

You may also set guidelines for the retention, deletion and communication of Your personal data after your death. In the absence of such guidelines, Your personal data will be retained in accordance with the paragraphs above, unless Your heirs request faster deletion.

9.          How is your personal data protected?

As data controller, BAR SOLUTIONS undertakes to implement and maintain, at its own expense, appropriate technical and organizational measures regarding the processing and security of personal data, in accordance with Articles 32 to 34 of the GDPR and 70-13 of the Data Protection Act.

BAR SOLUTIONS therefore ensures that these technical and organizational measures are at all times adapted to the specific risks presented by its processing activities, with regard to the nature of the information likely to pass through the Site, in particular to protect Your personal data against destruction, loss, modification, unauthorized disclosure or access, whether accidental or illicit.

Thus, with regard to the technical measures implemented by BAR SOLUTIONS:

-        all personal data is stored on servers located in France ;

-         All information relating to the banking transaction is encrypted both during its transmission via an SSL connection from the source to the target. Bank card data is not collected or stored by BAR SOLUTIONS;

-         administrative access to our servers is limited to certain declared IP addresses  at our hosting provider.

Regarding organizational measures:

-        only certain members of BAR SOLUTIONS staff listed exhaustively  are authorized to have access to personal data concerning you;

-        access to data is protected by user names and passwords;

-        The servers used are controlled by security groups.

BAR SOLUTIONS also undertakes to maintain, update, and retain complete and accurate records regarding the processing of personal data carried out by BAR SOLUTIONS. These records detail its processing activities.

In principle, your personal data is stored on servers located in France.
